These Terms of Service (“Terms”) govern your access to and use of the website at biztoolstore.com (the “Site”), operated by Covalent Ventures, Inc., doing business as Kimberlite Digital Marketing (“Company,” “we,” “us,” or “our”), which operates the Biz Tool Store brand. By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site you represent that you meet these requirements and that any information you provide is accurate and current.

2. The Site Is Informational; Services by Separate Agreement

The Site provides general information about our products and services and lets you contact us and request consultations. Any engagement for paid products or services is governed by a separate written agreement between you and us. Nothing on the Site is an offer to provide services on particular terms, and submitting a form does not create a client relationship or any obligation on our part to provide services.

3. Communications Consent

When you submit your contact information, you agree we may contact you by phone, text message, and email as described at the point of collection and in our Privacy Policy, including for follow-up and marketing. Consent is not a condition of purchase. You can opt out of texts by replying STOP and of marketing emails via the unsubscribe link. Message and data rates may apply.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may modify these Terms at any time. Changes are effective when posted with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. We may assign these Terms; you may not assign them without our consent.
